Wrongful Death Caused by Driver Failing to Yield at Stop Sign

Wrongful Death Caused by Driver Failing to Yield at Stop SignA Shelley woman was killed in a wrongful death accident due to another driving failing to yield at a stop sign. After colliding, both vehicles came to rest in a nearby field. The first deputy on the car accident scene found the Shelley woman trapped and unconscious in her vehicle. Witnesses, as well as the deputy, began first aid until emergency personnel arrived at the scene. The woman had to be extricated from the vehicle before being taken by ambulance to a nearby medical center where she died from serious injuries. The at-fault driver was able to free himself from his vehicle and attended to the Shelley woman before emergency services arrived. Both drivers were reportedly wearing seat belts at the time of the crash. There were no signs of alcohol or drugs being involved in the accident according to the press release.

Stop Sign Accidents

The most common scenario that causes a crash at a stop sign is when a driver just doesn’t see another vehicle coming. It could be the vehicle that is required to stop doesn’t, or it stops but fails to yield the right of way. These scenarios make up 70 percent of all crashes at stop signs. Only 17 percent of car accidents involved the driver running through a stop sign.

At a stop sign, drivers are required by law to not only stop but look for vehicle conflicts before proceeding. However, drivers don’t always judge correctly and thus result in a car crash. 44 percent of drivers involved in a crash at a stop sign say they just didn’t see the other car coming. Another 16 percent said their views were obstructed. These statistics are from a study conducted by the Insurance Institute for Highway Safety.

What is Wrongful Death?

Wrongful death is a legal term to describe a claim that certain individuals can make against a person who wrongfully or negligently causes the death of another. Wrongful death claims are enacted by the state legislature to govern who can bring a wrongful death claim.

A wrongful death lawsuit allows the victim’s family to seek out compensation any financial losses acquired as a result of the death. Wrongful death is also a way the family can seek justice against the negligent party.

How is a Fatality Crash a Wrongful Death Case?

The following are some scenarios in which filing a wrongful death case would be applicable.

Car Accident

Many wrongful death cases are filed after a fatal car accident. There are many ways the other driver can be found negligent for the victim’s death following a car accident. For instance, a distracted driver who caused a car crash can be held responsible for their negligent behavior through a wrongful death case if they killed the other driver. Anyone operating a motor vehicle is under oath to act responsible and drive safely. When a negligent driver chose to do otherwise and harms another, they should be held accountable.

Driving Under the Influence

A driver under the influence of drugs or alcohol is a prime candidate for being held responsible for a fatality. Clearly it is easy to see the negligence of a drunk driver.

Premises Liability

Incidents such as a slip and fall accident where the owner of the property should have known of the hazardous circumstances that caused a death make the owner liable of negligence. It is rare for a person to die from a slip and fall accident or other common premise liability scenarios. However, situations such as an accidental drowning, also fall under this category.
